                <text>I have been worried for some time that while we can claim to be democratically elected (unlike the R IBA) to ARCUK, the links we have with unattached architects are tenuous.	The annual election statement is an inadequate form of communication. But if the unattached continue to grow we must find some way of ensuring that the ideas we supposedly represent are well understood by our constituency. It is all very well the AJ quoting "unattached leader John Allen" referring to NAM principles, but these were formulated nearly a decade ago. Furthermore are we ourselves in agreement as to what these are?&#13;
I think it would be futile to try and organise a conference or even regional meetings - too much work for too little return.	Instead I think we should produce a handbook setting out our ideas and giving an account of what we do in ARCIJI&lt;.	If launched at a Press conference, with attendant publicity and adverts in the Press, we would get at least some unattached writing to us for copies. Such a document could be written so that it doesn't date too quickly and could be used to broaden support through mentions in community, trade union and political publications. We could even have a go at the National Press.&#13;
If we are serious about ideas to have architects accountable to society through ARCUK we need a document which sets out our programme succinctly and backs it up with supporting data.	This can be used to lobby the Labour Party and the Alliance in an effort to get our ideas adopted in their programmes. We have only two years to get this done unless we want to see Rod Hackney as personal architectural advisor to Neil Kinnock as well as Prince Charles vlLm€ &#13;
2 .&#13;
I suggest a document which we could write easily from material most of us have to hand. Dividing up the work and then circulating a final draft can be an efficient way to get things done.	I would be willing to take on some of the editorial and administrative functions providing we agreed to meet for a day to final ise the text.&#13;
I suggest that we finance it by putting in an amount like DO each which we would recoup from sales - but we would need to look for further money for advertising and distribution.	I am circulating this before the next Council meeting, hopefully there will be an opportunity to discuss it then.	If you will not be there - please 'phone me by October 10 with your comments.&#13;

 We hold reservations about omiss ions from the alternative, in particular •or preference" Is it not a cause for concern when equal opportunity employers are stating "preference will be given to&#13;
2) We also cons ider it is important to communicate the concern of the PPC regarding the pitfalls of unreasonably limiting choice.&#13;
In addition I do not like the inclusion of the word "professional • .&#13;
I note that the alternative still includes the words n or advancement" and • in addition to n	I recall Mr McCarthy citing these late additions to the printed agenda as the reason for his unease regarding the entire Advice Note and I think it clearly illustrates his muddled thinking, due perhaps to his hurried attempts at stalling Councils acceptance of the Note.&#13;
Having cons idered the various texts again I offer yet another alternative:&#13;

It was noted that this was the first meeting of the newly formed Group which in effect had not met for two and a half years.&#13;
2. The Group had before it the text of four motions which had been put to the Council at its March meeting on the proposal of Mr Arnold seconded by Mr Walker. The matter had been remitted to the Professional Purposes Comittee for examination and report and the purpose of the present meeting was to give the Professional Purposes Comittee at its meeting on May 1st the benefit of the Group's technical examination.&#13;
The Chairman introduced the subject by saying that the centre of discussion was the practice of having RIBA me±ership as a requirement in various employment situations. A preliminary survey of eight issues of the publication Architects Journal had shown that out of 35 advertisements by local authorities 10 had mentioned umbership of the RIBA as a for applicantJ and out of 247 practices advertising two had mentioned the same requirement. Various other statistics were mentioned by the Group in other publications.&#13;
The Chairman went on to say that notions A and B appeared to be similar, with C and D in rather a different category,&#13;
Mr Arnold said that it seemed to be rather a discriminatory situation when it arose in public autmrity advertising but there was also relevance in private advertiseænts where architects were in control.&#13;
Turning to the wording of the motions the Chairman pointed out that it was a key-note of the publication '*Conduct and Discipline" that a prohibition should not be specified and therefore to describe anything as "unacceptable conducta would be out of court. This practice could not be seen as per se disgraceful conduct.&#13;
Mr Arnold said it was not being suggested that any case should automatically rank for the Discipline Comittee t s attention but in a blatant case reference might be made to the Solicitor Complainant with the object of bringing pressure rather than to discipline. &#13;
Mr Benroy pointed out that it should not be forgotten that AIL constituent bodies were involved because even if it were rare for the acronyms of other constituent bodies to be stipulated reference to the RIBA could be read as ruling out the others. Mr Nickolls pointed out that the PPC t s attitude in the past had been to see this practice not by way of the Standard of Conduct but as the exercise of the freedom of any employer to make stipulations about netlbers of his staff.&#13;
The Chairman queried whether the practice could be seen as reflecting on an architect's integrity.&#13;
Mr Allan said it had to be seen in relation to the law affecting of association and in particular Section 17 of the 1931 Act. There certain specifications were laid down before a corporate body could describe itself as "architects n ; this practice proposed an additional filter which the law did not recognise. It was his contention that that was wrong and introduced a distortion of the conditions specified by the law.&#13;
Mr Benroy said he rather agreed with this and Mr Nickolls said that he was persuaded that the matter could not just be dismissed as if it was not relevant to the Standard of Conduct.&#13;
There followed some discussion on the extent one could combat an employers right to lay down what conditions he wanted and whether an artifical restriction operated to the disadvantage of the employee or the public. If one could breach integrity by laying down unreasonable conditions could that be said of a preference?&#13;
Mr Allan said that the question should be put in the form whether or not the preference was reasonable.&#13;
There followed some discussion on the nuances inherent in a requirement as distinct from a preference.&#13;
The Group finally came to the conclusion that there is an identifiable relationship between this practice and the Standard of Conduct. It was also agreed that there was action that ARCUK could take and that this should best be done as regard the contents of nntions A and B by the publication of an additional "Advice to Architects" in terms of the attached draft.&#13;
It was also felt that the substance of motion C and 	D called for the publication of the document by way of insertion in the 19821/5 Annual Report and distribution to other named addressees. It was agreed that this propositon should be put to the Professional Purposes Comittee at its next meeting with the suggestion that the Comittee recomend to Council accordingly.&#13;
Mr Arnold said that in the event of the Council accepting the new edition to the "Advice to Architects" he saw no reason why the four motions should not be withdrawn.&#13;

This Council considers that discrimination exercised by an architect employed by a Local, District or Metropolitan Authority or Central Government, based on the premise that a condition of employment or engagement of an architect by the Authority will be the membership of an institute or similar organisation, constitutes unacceptable conduct when measured against the ARCUK document "Conduct and Discipline" .&#13;
MOTION C&#13;
This Council directs the Registrar to write to the Secretary of the&#13;
National Joint Council for Local Authorities with the request that the Secretary once again reiterates the statement circulated by the NJ CLA in 1978 to the Chief Executives of all Authorities.&#13;
The statement should consist (as previously) of 'l a firm reiteration that membership of the RIBA should not be inferred as conferring any additional qualification" with regard to the title or job description of architect.&#13;
This communication should be made with particular reference to (but not exclusively) recruiting advertisements and conditions of employment for architectural staff.&#13;

It should also be pointed out to Authorities that many describe themselves as "equal opportunity employers" and as such they should not discriminate against architects who choose not to belong to one particular institute or another.&#13;

H. &amp; R. Johnson Tiles Ltd Sir: I write to correct a number of statements made in your Products in practice supplement on plaster, render and tiles (AJ 4.7.84). First, the assertion that British ceramic tile manufacturers have followed the continentals in marketing a 'universal' tile has no foundation. The Johnson universal edge has, since the late 1970s, remained unique in that it is self-spacing, thereby acting to replace spacer and border tiles while leaving sufficient width for the grouted joints. We know of no continental tile that has this facility.&#13;
Second, in conjunction with our sister company, A. G. Tiles, H. &amp; R. Johnson manufactures in&#13;
14 different sizes including those&#13;
(200 x 150 mm, 200 x 200 mm and 300 x 200 mm) which you suggest are the preserve of the continentals. Rest assured, if the UK market demands even bigger tiles in sufficient commercial quantities then the companies of the Norcros Ceramic Division are quite prepared to meet that demand. Seifert has never been a 'substantial benefactor' to the Heinz. Indeed he has never been a benefactor to the Drawings Collection at all. Thank you for your letter of 6 May addressed to the Secretary of State . I have been asked to reply.&#13;
The parliamentary Under -Secretary of State answered a question on I April to the effect that the bodies which the Secretary of State has in mind to designate are those suggested in the Consultation letter of 17 September, ie CIOB, FAS, IAAS, IBCO, ICE, 1StructE, RIBA and RICS.&#13;
At least 3 of these bodies have said that they will consider applications from 'Unattached architects There will be further consultation before final arrangements are made, and I repeat the undertaking we gave you at the meeting on 18 April last year that your representatives will be invited to the next meeting with the professional institutions.&#13;
It is intended that the new building regulations and the approved inspectors regulations will come into operation before the end of the year. The extent to which individual approved inspectors will be able to operate at that stage will depend on acceptable insurance arrangements being made, and at the moment there are difficulties in that are.a . This is another matter which is likely to be discussed at the next meeting, to which, I repeat you will be invited.&#13;
In the meantime you may be interested to see a draft of the new building regulations and of the proposed manual, copies of which I enclose.&#13;

APPROVAL OF INSPECTORS AND PRIVATE CERTIFICATION FOR BUILDING CONTROL&#13;
Building Act 1984&#13;
Thank you for your letter addressed to the FAS Secretary under the above reference dated 2nd ultimo.&#13;
As Chairman of the Practice Working Party dealing with this matter with the Department of the Environment, your letter was passed to me for response, but firstly I would apologise for the inordinate delay in writing to you.&#13;
The position in principle as far as the FAS is concerned in relation to approval of Inspectors, etc. , is as follows:&#13;
An unequivocal statement has been given to the DOE to the effect that an approval service for Unattached Architects seeking recognition as Inspectors would be undertaken as soon as possible following upon establishment of the appropriate legislation framework.&#13;
.	No service of this nature could, however, be considered without prior establishment of criteria for approval which would be common to all Professional Organisations listed by the DOE as appropriate for the task; and moreover, such criteria would have to be wholly acceptable to the DOE. Furthermore, criteria for approval of Unattached Architects should be the same as for all other UK architects.&#13;
.	Criteria for approval would have to include adequate provision for establishment of a sound knowledge of Building Regulations in the case of each applicant. However, against the background of the current (but so far unadopted) Building Regulations, the FAS would look to identifying also in the applicant of appreciation of innovative constructional design, which those Regulations are now formulated to permit.&#13;

Building Act 1984 Approval of Inspectors and Private Certification for Building Contro.l&#13;
The Secretary has asked me to thank you for your letter dated 2nd April, written on behalf of elected representatives of Unattached Architects on ARCUK, and to reply.&#13;
The Secretary of State for the Environment has in mind designating the RIBA amongst other bodies for the purpose of approving inspectors under section 49 of the Building Act 1984. Should the RIBA be so designated the Council has indicated its willingness to undertake the examination of any applicant who is a registered architect. ffhis will be on a self financing basis.&#13;
The examination would cover the suitability of the applicant t s professional qualifications, the appropriateness of professional post—qualification experience, and the familiarity with the building regulations and approved documents. Applicants would be charged assessment fees, and an annual retention fee for inclusion on the list of approved inspectors which the Institute would be required to maintain.&#13;
The first stage would entail the applicant completing an application form identifying basic professional qualifications and work experience, and any limitations which was desired to have imposed on the range of buildings for which the applicant would act. A successful applicant would be invited to proceed to the second stage.&#13;
The second stage would entail assessment of the applicants Imowledge of the law relating to buildings and building and of technical matters. The assessment would entail written papers and oral interview to test the applicant's competence and suitability to undertake the functions of an approved inspector.&#13;
A non—returnable fee would be payable with the application for each s tage .&#13;
A successful applicant would then be invited to apply for listing, for which an annual retention fee would be payable, compounded for a five year period, whereupon a certificate to that effect would be issued.&#13;
&#13;
The foregoing represents the Institute t s present intentions based upon the Department of the Environment t s statutory consultation document for Building (Approved Inspector etc) Regulations. They may be modified in the light of the Regulations actually made, and our further consideration of the matter with other possible designated bodies.&#13;

Thank you for your letter of 2nd April, 1985 referring to the fact that this Association is likely to be one of the eight designated bodies to approve Inspectors under the above Act.&#13;
The Management Board of the Association has agreed that it is prepared to 'vet' any would—be Approved Inspector whether or not that person is a member of our Association or otherwise. The exact method of vetting has yet to be determined but it has already been established that it would be a function out— side that of the Association's Education and Examinations Board.&#13;
At present we are involved in discussions with other interested potential designated bodies with the thought of setting up a Joint Examination Board where there is difficulty in establishing the applicant ' s knowledge of Building Regulations and Approved Documents . It is also our intention to have two grades of&#13;
Approved Inspectors one of which will be confined to the inspection of residential and similar small buildings and the other which will cover a complete range of building work. In common with the other designated bodies we would expect an applicant for the lower grade to have five years post—professional qualification experience and for the upper grade, a minimum of ten years post professional qualification experience.&#13;
I am sorry not to be able to provide you with more information at present but will be pleased to do so as it becomes available.&#13;
You would no doubt think it strange if I did not point out that it is of course possible for any unattached architect to become a member of this Association if he so wished.&#13;

REPRESENTATION OF UNATTACHED ARCHITECTS: ELECTION OF MEMBERS OF THE COUNCIL FOR THE YEAR ENDING IN MARCH 1986, UNDER PARAGRAPH 1 (vii) OF THE FIRST SCHEDULE TO THE ARCHITECTS (REGISTRATION) ACT, 1931 NOTIFICATION OF RESULT OF VOTING.&#13;

By the close of the voting period on Thursday, 7th February 1985, (Reg .45&#13;
(6) (f) ) , ballot envelopes had been received as follows: —&#13;
Bearing a signature. 1 ,401&#13;
Unsigned and therefore discarded48&#13;
Bearing a name other than that of the registered voter, and also discarded10&#13;

Additionally 42 ballot forms were returned, unsigned, in other envelopes and these were also discarded.&#13;
The 1,401 signed envelopes were duly checked against the Voters' List and 18 were discarded because of indecipherable signatures. The remaining 1,380 were then opened and the contents extracted and examined. Two papers were found to have more than the permitted number of votes recorded and declared invalid. Votes on the valid forms were cast for the 19 candidates as shown on the attached computer list.&#13;
